Terms of Service

Lytbub Studios ("we", "us", "our") is a brand operated by Lytbub Technologies LLC, an Arizona limited liability company with its principal place of business in Phoenix, AZ.

These Terms govern your use of:

• The Lytbub Studios website at lytbub.studio
• The Lytbub HQ client portal (where applicable)
• Any related applications, services, content, or tools we provide

By accessing the site, creating an account, submitting a lead form, signing a contract, or using any feature, you agree to be bound by these Terms.If you don't agree, don't use the site.

You must be at least 18 years old and legally able to enter contracts. If using on behalf of a business, you represent you have authority to bind that business.

• You're responsible for what happens on your account. Keep your password private.
• One person per account. Don't share login credentials.
• We may suspend or terminate accounts that violate these Terms, that we reasonably suspect of fraud, or that haven't been used in over 18 months.

Digital studio services including website and app development, brand identity, video production, hosting, technical setup, monthly retainers, and consulting. Specific deliverables, scope, fees, and timelines are governed by the individual Service Agreement (SOW) you sign for each engagement.

• Quoted prices on the marketing site are estimates and starting points, not binding offers. Final pricing is set in your signed SOW.
• Founding-customer pricing applies only to clients who sign their first SOW during the founding period stated on the marketing site.
• Monthly retainers are billed in advance on the scheduled day of each calendar month and continue until cancelled with at least 14 days written notice via billing@lytbub.com.
• Project work is billed per the payment schedule in your SOW (typically 50% deposit, 50% on completion).
• Failed payments: We use Stripe's Smart Retries, which attempts up to 3 charges over ~3 weeks. If all retries fail, services may be paused until balance is cleared.

All payments are processed via Stripe, Inc.Your card and bank information is held by Stripe, not us. We don't store full card numbers. All amounts in USD unless stated.

• Discovery Sessions, audits, consultations: non-refundable once delivered.
• Project deposits: non-refundable once work has started.
• Retainer fees: non-refundable for the month they cover. Cancellation effective at end of current cycle.
• Disputed charges: contact billing@lytbub.com before initiating chargeback.

What you own: Final delivered work transfers to you upon final payment. Your data remains yours.

What we own: Our tools, frameworks, reusable components, the Lytbub HQ platform itself, and the Studio Brain AI assistant. Unless your SOW says otherwise, we may feature completed work in our portfolio.

We use AI tools, including Anthropic's Claude, to assist with various tasks. A human reviews any communication or deliverable sent on your behalf unless we explicitly agree otherwise in writing. We don't use your data to train AI models. Anthropic's paid API does not train on customer data.

If you're not comfortable with AI assistance on your account, email admin@lytbub.comto flag your account as "no AI".

You agree not to:

• Use the site to violate any law
• Access accounts or systems you're not authorized to access
• Reverse-engineer or scrape the platform
• Upload malware or harmful content
• Impersonate another person or business
• Use the site to compete with us by building a similar studio platform

The site integrates with Stripe, Supabase, Anthropic, Resend, Vercel, and Cloudflare — each governed by their own terms. Use of our site means you also accept their terms where applicable.

The site and services are provided "as is" and "as available", without warranties of any kind. We don't warrant any specific business outcome.

To the maximum extent permitted by law, Lytbub Technologies LLC's total liability for any claim is limited to the greater of $500 or the amount you paid us in the 12 months before the claim.We're not liable for indirect, consequential, incidental, or punitive damages.

You agree to defend, indemnify, and hold us harmless from claims arising from your violation of these Terms, your violation of any law or third-party right, or content you provide that infringes third-party rights.

Informal first: contact admin@lytbub.com and try to resolve informally for at least 30 days.

Governing law: Arizona.

Venue: state or federal courts in Maricopa County, Arizona.

Class action waiver: claims brought only in individual capacity.

We may suspend or terminate access at any time. Sections that should survive — payment obligations, IP, liability limits, indemnification, dispute resolution — survive.

For material changes, we'll email registered users at least 14 days before the change takes effect. Continued use after the change means you accept the new Terms.
